The Website may include beta features or experimental services that are provided "as-is" without any guarantees of functionality, reliability, or performance. Users acknowledge and accept the risks of using these features, including the possibility of bugs, errors, or service interruptions.

2. User Assumes All Risks

Users acknowledge and accept all risks associated with using the Website and its services, including but not limited to:

• Potential downtime, bugs, or malfunctions of the Web3 plugin or Website.
• Code vulnerabilities, hacking, phishing, fraud, or unauthorized access.
• The Website being hacked or hijacked, and malicious code or links being inserted, which may result in the loss of wallet assets or other damages.
• Social engineering attacks, fraudulent links, or scams.
• Blockchain network delays, congestion, or failures.
• High volatility and fluctuations in the value of tokens or NFTs.

The Provider is not responsible for any losses, damages, or liabilities arising from these or other risks inherent in blockchain-based technologies. Users are solely responsible for understanding and mitigating these risks.

3. Safeguarding Wallets

Users are solely responsible for safeguarding their wallets, including private keys, seed phrases, and credentials. The Provider does not have access to Users' private keys, cannot assist in recovering lost assets, and is not liable for any unauthorized access to or loss of wallet assets. Users are advised to ensure maximum security for their wallets and credentials to protect against phishing, hacking, social engineering, or other unauthorized access.

Users are encouraged to:

1. Use secure internet connections and avoid public Wi-Fi.
2. Ensure their devices are malware-free.
3. Verify the authenticity of all communications claiming to originate from the Website or the Provider.

4. User Warranties

By using the Website, Users warrant and agree to the following:

1. They own or have all necessary rights, licenses, and permissions to upload any content, including images, to the Website.
2. They will refrain from engaging in disruptive acts that directly or indirectly interfere with the Website's functions, services, or operations.
3. They will comply with the Provider's Code of Conduct, as amended from time to time, and acknowledge that non-compliance may result in suspension or termination of access.
4. Their use of the Website, including token airdrops and NFT minting, complies with all applicable laws and regulations in their jurisdiction.

Users indemnify and hold the Provider harmless for any claims, damages, or liabilities arising from breaches of these warranties.

5. Complete and Final Discretion Over Uploaded Content

The Provider reserves the complete and final discretion to monitor, review, and determine whether any content uploaded to the Website complies with the Code of Conduct or these T&C. The Provider may remove or refuse to use any content deemed inappropriate, harmful, or otherwise unsuitable for use on the Website or its services. The Provider assumes no responsibility or liability for content uploaded by Users, including but not limited to copyright violations, defamation, or other legal disputes arising from such content. Users acknowledge that they are solely responsible for the legality, accuracy, and appropriateness of any content they upload to the Website.

6. Intellectual Property and Non-Endorsement

By uploading content to the Website, Users grant the Provider a global, perpetual, royalty-free, non-exclusive license to:

• Use, reproduce, modify, display, and distribute the content.
• Sub-license the content to third parties.
• Publish the content in marketing campaigns, promotional materials, or other media.

This license does not transfer ownership of the content to the Provider. Users may revoke the license by deleting the content, provided it has not already been used or sublicensed.

The Provider may monitor or verify the legality of uploaded content as necessary, including in response to complaints or suspected violations of intellectual property laws. Notwithstanding this, the Provider disclaims all liability for copyright or trademark infringements arising from Users' actions. Users are solely responsible for ensuring that any content they upload, modify, or generate using the Website complies with applicable intellectual property laws. The Provider does not endorse any individual memes. The messaging, any viewpoints expressed, are the viewpoints not of the Provider but the individual users who created the memes. The Provider cannot be held responsible for content created, even if the content passes the Provider's automated or manual content moderation and complies with the Code of Conduct.

The Provider retains all rights, title, and interest in and to the Website, including proprietary algorithms, software, templates, tools, branding, and trademarks (registered or unregistered). Users may not reverse-engineer, decompile, or attempt to extract the source code of the Website, its services, or Web3 integrations.

IP Owners: If the User is an alleged intellectual property (IP) owner, their use of this Website is based on the understanding that the Provider has limited control or moderation over user-generated content. Alleged IP owners expressly acknowledge and agree that any claims, disputes, or recourse related to infringing content must be pursued directly against the User responsible for uploading the content, and not against the Provider.

7. Limitation of Liability

To the maximum extent permitted by law, the Provider shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to:

• Loss of data, profits, business, or assets.
• Unauthorized access to Users' wallets or data.
• Any damages arising from the use or inability to use the Website or its services.

All fees charged by the Website or Provider, including but not limited to NFT minting fees or service charges, are non-refundable. Users acknowledge that blockchain transactions are irreversible and that the Provider cannot reverse or refund fees paid in connection with blockchain transactions.

8. Indemnification

Users agree to indemnify, defend, and hold harmless the Provider, its affiliates, and employees from any claims, damages, losses, liabilities, costs, or expenses arising from:

1. The User's use of the Website or its services.
2. Uploaded content that infringes upon third-party intellectual property rights.
3. Breaches of these T&C or misuse of the Website.
4. Compliance with any valid takedown notices or legal claims related to content uploaded by the User.

9. Code of Conduct and Prohibited Uses

Users must comply with the Provider's Code of Conduct and agree not to engage in any prohibited activities, including but not limited to:

• Uploading harmful, obscene, defamatory, or illegal content.
• Engaging in fraudulent activities, phishing, or impersonation.
• Violating intellectual property rights of others.
• Attempting to gain unauthorized access to the Website, its systems, or other Users' accounts through hacking, phishing, bots, or other artificial intelligence, automated or non-automated systems or methods.

Violations of these T&C or the Code of Conduct may result in suspension, termination, or legal action at the Provider's discretion.

10. Privacy Policy

The Provider's Privacy Policy is separately available and is incorporated by reference.

11. Airdrop and Competition Eligibility

The Provider reserves the final right to determine the final eligibility of any airdrops, competition, or any other form of rewards, notwithstanding eligibility criteria or checks, which are for reference only. Users acknowledge that they have no recourse against the Provider for any claims, even if they fulfill the stated requirements.

The Provider is guided by its internal policies against abuse, for example where a user may open multiple wallets in order to abuse the reward system. This is just an example, the Provider reserves the final right to determine eligibility.

The Provider is not responsible for fraudulent or unauthorized claims of airdrops facilitated through third-party wallets or platforms. Users also accept the risks of scams or social engineering attacks.

12. Termination and Suspension

The Provider reserves the right to suspend or terminate any User's access to the Website or its services at its sole discretion, without notice, for violations of these T&C or the Code of Conduct, misuse of the platform, or any other reason deemed appropriate by the Provider.

13. Acknowledgment and Full Acceptance of Web3 Risks

Users acknowledge and fully accept the risks of interacting with blockchain-based technologies, including loss of private keys, blockchain network failures, high volatility, and legal or regulatory changes.

14. Governing Law and Dispute Resolution

Disputes are subject to arbitration under the Hong Kong International Arbitration Centre (HKIAC) rules.

15. Force Majeure

The Provider is not liable for events beyond its control, such as cyberattacks or blockchain failures.

16. Updates to T&C

The Provider reserves the right to update or modify these T&C at any time at its sole discretion. Any changes will become effective immediately upon being published on the Website, and continued use of the Website constitutes binding acceptance of the updated terms without further notification or agreement.

17. Geographic Restrictions

Users are responsible for ensuring compliance with laws in their jurisdiction.

18. Age Restrictions
